Verdict Obtained by GBC Attorney Affirmed
The Court of Appeals of the State of Washington issued an opinion on March 11, 2013 affirming in all respects a Jury Verdict, Dismissal of Claims and Sanctions obtained by GBC Shareholder Steve Fallon. The case is Northwest Product Design Group, LLC. et al v. Homax Products, Inc. et al., Appeal No. 67278-9. Steve argued the appeal on September 5, 2012. The opinion can be read here.
The decision on appeal affirms a unanimous jury verdict and related rulings obtained by Steve on behalf of Homax Products. The opinion of the Court of Appeals upheld the dismissal on the pleadings of allegations concerning violation of the Washington Consumer Protection Act, Fraud and Negligent Misrepresentation, Tortious Interference with Prospective Economic Advantages and Unfair Business Practices. The unanimous Jury Verdict and Equitable rulings after trial in favor of Homax were also affirmed.
